My Lux Vacation — Curated Travel Experiences

These Terms of Use ("Terms") govern your access to and use of the website at myluxvacation.com (the "Site") and the travel planning and booking services provided by My Lux Vacation ("My Lux Vacation," "we," "us," or "our") (the "Services"). By accessing the Site, submitting an inquiry, or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or our Services.

Please read these Terms carefully, particularly the Disclaimers and Limitation of Liability sections below, which limit our liability to you.

1. Our Role as a Travel Agency

My Lux Vacation is a travel agency that helps you plan and book travel — including cruises, resorts, honeymoons, corporate travel, and custom itineraries. In doing so, we act as an intermediary and agent between you and independent third-party travel suppliers, such as airlines, cruise lines, hotels and resorts, tour and excursion operators, car-rental companies, transfer providers, and travel insurers ("Suppliers").

We do not own, operate, manage, or control any Supplier, and we are not the provider of the travel services you ultimately purchase. The Suppliers are independent contractors and are not our agents or employees. Your travel arrangements are subject to the terms, conditions, and policies of the applicable Suppliers (including their fare rules, cancellation and change policies, and limitations of liability), which form a separate contract between you and the Supplier. We encourage you to read those Supplier terms carefully before booking.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use our Services and make bookings. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete. If you make a booking on behalf of others, you represent that you are authorized to act on their behalf and that you have shared these Terms with them.

3. Quotes, Bookings, and Pricing

  • Quotes. Quotes and proposals we provide are estimates based on availability and pricing at the time they are prepared. Prices, availability, and promotions can change at any time and are not guaranteed until a booking is confirmed and paid in accordance with the applicable Supplier's requirements.

  • Confirmation. A booking is confirmed only when the relevant Supplier has accepted it and any required deposit or payment has been received. We are not responsible for a Supplier's refusal to confirm a booking.

  • Accuracy of information. You are responsible for providing accurate traveler details (including names exactly as they appear on travel documents). Errors may result in additional fees, denied boarding, or cancellation, for which you are responsible.

  • Pricing errors. In the event of an obvious error in pricing (for example, a Supplier or display error), we and the Supplier reserve the right to correct the price or cancel the affected booking.

4. Payments, Fees, Changes, and Cancellations

  • Payment. Deposits and payments are generally made to, or as directed by, the applicable Supplier and are governed by that Supplier's payment schedule and policies. Failure to pay on time may result in cancellation by the Supplier and loss of deposits.

  • Service fees. We may charge professional planning, service, or change fees in addition to Supplier costs. Any such fees will be disclosed to you before they apply and, unless stated otherwise, are non-refundable once services have been rendered.

  • Changes and cancellations. Changes, cancellations, and refunds are governed by the applicable Supplier's policies, which may include penalties or be entirely non-refundable. We will assist you in communicating with Suppliers but cannot waive or override their policies and do not control whether a refund is granted.

5. Travel Documents, Health, and Entry Requirements

You are solely responsible for ensuring that you and all travelers in your party hold valid passports, visas, permits, and any required health documentation, and that you meet all entry, exit, health, and other requirements for your destinations and any transit points. Requirements can change and vary by nationality and destination. We are not responsible for any loss, expense, or denied travel resulting from a failure to obtain proper documentation or to meet such requirements. We strongly recommend confirming current requirements with the relevant authorities (such as embassies, consulates, and official government and health sources) before you travel.

6. Travel Insurance

Travel can be disrupted by events outside anyone's control. We strongly recommend that you purchase appropriate travel insurance to cover trip cancellation and interruption, medical expenses, emergency evacuation, baggage, and other risks. If you decline travel insurance, you accept responsibility for any financial loss associated with your travel arrangements.

7. SMS Text Messaging

If you provide your mobile number and opt in to our text-messaging program, the following terms apply:

  • Consent and message types. By opting in, you agree to receive marketing and conversational (customer care) text messages from My Lux Vacation at the mobile number you provide, sent from +1 (717) 759-5833. Conversational/customer care messages may include responses to messages you send us and information relevant to your relationship with us. Marketing messages may include discount codes, special deals, and texts promoting our products and services. Consent is not a condition of purchase.

  • Message frequency. Message frequency varies.

  • Message and data rates. Message and data rates may apply.

  • Opting out. You can unsubscribe at any time by replying STOP to any message. After you opt out, we will send a single confirmation message and will not send further messages unless you opt in again.

  • Help. Reply HELP for assistance or more information, or contact us at (717) 759-5833 or info@myluxvacation.com.

  • Privacy. We do not share your mobile opt-in information with anyone for their own marketing purposes. See our Privacy Policy for details on how we handle information related to text messaging.

  • Carrier disclaimer. Mobile carriers are not liable for delayed or undelivered messages.

8. User Accounts and Conduct

If you create a member, affiliate, or vendor account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree not to:

  • Use the Site or Services for any unlawful, fraudulent, or unauthorized purpose;

  • Submit false, misleading, or inaccurate information;

  • Interfere with or disrupt the Site, its security, or its underlying infrastructure;

  • Attempt to gain unauthorized access to any part of the Site or to other users' accounts; or

  • Use any automated means to scrape, harvest, or collect data from the Site without our permission.

We may suspend or terminate your access to the Site or Services at any time for conduct that violates these Terms or that we reasonably believe may harm us, other users, or third parties.

9. Reviews, Submissions, and User Content

If you submit reviews, testimonials, photos, or other content to us or on the Site, you grant My Lux Vacation a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt that content in connection with our business and marketing. You represent that you own or have the right to submit the content and that it does not violate any law or third-party right. We may remove or decline to publish any content at our discretion.

10. Intellectual Property

The Site and its content — including text, graphics, logos, the "My Lux Vacation" name and "Curated Travel Experiences" tagline, images, and design — are owned by or licensed to My Lux Vacation and are protected by intellectual property laws. You may use the Site for your personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

11. Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is accurate, complete, or current.

Because we act as an intermediary (see Our Role as a Travel Agency above), we make no warranty or representation regarding the quality, safety, suitability, or performance of any Supplier or travel service. Any dispute regarding the travel services themselves is between you and the applicable Supplier.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MY LUX VACATION AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES OR YOUR TRAVEL ARRANGEMENTS.

We are not liable for the acts, errors, omissions, representations, breaches, or negligence of any Supplier, or for any personal injury, death, property damage, delay, cancellation, or other loss arising from causes beyond our reasonable control. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the amount of the service fees you paid directly to My Lux Vacation for the booking giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless My Lux Vacation and its owners, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or Services, your travel arrangements, your violation of these Terms, or your violation of any law or third-party right.

14. Force Majeure

We are not responsible for any failure or delay in performing our obligations where the failure or delay results from events beyond our reasonable control, including natural disasters, severe weather, pandemics or public-health events, acts of government, war, terrorism, civil unrest, strikes, supplier insolvency, or disruptions to transportation, utilities, or communications.

15. Third-Party Links and Services

The Site may contain links to or integrate third-party websites and services (such as Suppliers, mapping, fonts, image providers, and social media). We do not control and are not responsible for the content, products, or practices of any third party. Your use of third-party sites and services is at your own risk and subject to their terms and policies.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms, the Site, or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable rights you may have under applicable law.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site or Services after changes take effect means you accept the updated Terms.

18. Miscellaneous

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Lux Vacation regarding the Site and Services.
